1. Who We Are — phmob Data Controller

phmob operates the online casino platform available at phmob.vip (the "Platform"). For the purposes of the Philippine Data Privacy Act of 2012 (RA 10173), phmob acts as the Personal Information Controller (PIC) — meaning we determine the purposes and means by which your personal data is processed.

phmob does not collect sensitive personal information (as defined under RA 10173) unless it is directly required for PAGCOR compliance, responsible gambling obligations, or AML obligations. We do not collect racial or ethnic origin, political opinions, or religious beliefs.

3. How phmob Collects Your Data

phmob collects your personal data through the following channels:

  • Platform Improvement: Analyzing aggregated, anonymized usage patterns to improve the phmob user experience for Filipino players.
  • Marketing Communications (with consent): Sending promotional emails or SMS messages about phmob bonuses, new games, and tournaments — only where you have opted in to receive such communications.
5. Legal Basis for Processing

Under the Philippine Data Privacy Act of 2012 (RA 10173), phmob processes your personal data on the following lawful bases:

  • Contractual Necessity: Processing required to perform the contract between you and phmob — i.e., providing online gambling services, processing deposits/withdrawals, and maintaining your account.

6. Data Sharing and Third-Party Processors

phmob does not sell or trade your personal data. However, we share your data with the following categories of third parties in the ordinary course of providing our services:

  • Payment Processors: GCash (G-Xchange Inc.), PayMaya (Voyager Innovations), and Philippine banks (BDO, BPI, Metrobank) process financial transactions. These entities operate under BSP regulation and their own data privacy policies.
  • Identity Verification Providers: Third-party KYC and liveness-check providers assist phmob in verifying government-issued Philippine IDs.
  • Game Software Providers: Game studios and software providers may receive limited data necessary to deliver and certify their games on the phmob platform. They do not receive your financial or full identity data.
  • Cloud and Infrastructure Providers: phmob uses reputable cloud infrastructure providers to host the platform. These providers act as Personal Information Processors (PIPs) under data processing agreements.
  • PAGCOR and Regulatory Authorities: phmob shares data with PAGCOR, the Anti-Money Laundering Council (AMLC), and other government bodies when required by Philippine law or regulation.
  • Legal and Professional Advisers: phmob may share data with lawyers, auditors, and compliance consultants under strict confidentiality obligations where necessary.

All third-party processors engaged by phmob are bound by data processing agreements consistent with RA 10173 and the NPC's requirements for Personal Information Processors operating in the Philippines.

7. Cookies and Tracking Technologies

phmob.vip uses cookies and similar technologies to operate the platform, enhance user experience, and analyze platform usage. The following categories of cookies are used:

  • Strictly Necessary Cookies: Essential for login session management, security, and basic platform functionality. These cannot be disabled without breaking the platform.
  • Functional Cookies: Remember your language preferences, device settings, and recent game selections to provide a smoother experience on return visits.
  • Analytics Cookies: Collect anonymized data about how Filipino players interact with phmob — which games are most visited, load times, and session patterns. This data is used in aggregate to improve the platform.
  • Marketing Cookies (consent-based): Track whether you arrived at phmob via a promotional link, to attribute bonuses correctly and measure campaign effectiveness. Only active where consent is given.

You can manage cookie preferences through your browser settings. Note that disabling strictly necessary cookies may prevent you from logging in to your phmob account.

8. Data Retention Periods

phmob retains personal data for the following periods, after which data is securely deleted or anonymized:

  • Account and KYC Data: Retained for the lifetime of your active phmob account, plus 5 years after account closure — as required by AMLC reporting obligations.
  • Transaction and Financial Records: Retained for a minimum of 5 years from the date of each transaction, in compliance with AMLA requirements and BSP record-keeping standards.
  • Gaming Activity Logs: Retained for 2 years from the date of the session for responsible gambling monitoring, dispute resolution, and platform integrity purposes.
  • Support Communications: Retained for 3 years from the date of last contact, or the lifetime of the account — whichever is longer.
  • Marketing Consent Records: Retained until consent is withdrawn, plus 1 year for compliance records.

Where phmob is required by a court order, regulatory investigation, or legal proceeding to retain data beyond the standard periods above, we will do so for the duration of that requirement.

9. How phmob Protects Your Data

phmob implements appropriate technical and organizational security measures to protect your personal data from unauthorized access, accidental loss, destruction, or disclosure. These measures include:

  • Encryption in Transit: All data transmitted between your device and phmob.vip is protected by TLS 1.3 encryption, including login credentials, payment data, and account information.
  • Encryption at Rest: Sensitive personal data stored in phmob's databases is encrypted at rest using industry-standard AES-256 encryption.
  • Access Controls: phmob staff access to personal data is strictly limited on a need-to-know basis. Role-based access controls and multi-factor authentication are enforced for all internal systems.
  • Password Security: Player passwords are stored using one-way cryptographic hashing — phmob staff cannot read your password.
  • Security Monitoring: phmob monitors platform systems for suspicious activity, intrusion attempts, and unauthorized access attempts on a continuous basis.

Your Responsibility: phmob's security measures protect your data on our systems. However, you are responsible for keeping your phmob login credentials confidential. Do not share your password with anyone — including persons claiming to be phmob support staff. phmob will never ask for your password via email, chat, or phone.

10. Your Data Privacy Rights Under Philippine Law

As a data subject under the Philippine Data Privacy Act of 2012 (RA 10173), phmob players have the following rights with respect to their personal data:

Right to Access

Request a copy of the personal data phmob holds about you and information about how it is processed.

Right to Correction

Request correction of any inaccurate, incomplete, or outdated personal data phmob holds about you.

Right to Erasure

Request deletion of personal data no longer necessary for its stated purpose, subject to legal retention obligations.

Right to Restrict Processing

Request restriction of processing in specific circumstances — for example, while phmob verifies the accuracy of disputed data.

How to Exercise Your Rights

To exercise any of the rights listed above, submit a written request to phmob's Data Privacy Officer at the contact details provided in Section 12. phmob will respond to valid data subject requests within 30 calendar days of receipt, in accordance with NPC timelines.

We may request proof of identity before processing a data subject request to prevent unauthorized access to another person's data. Where a request is refused, we will provide written reasons and inform you of your right to file a complaint with the National Privacy Commission.

Note that some rights are subject to limitations under RA 10173 — for example, the right to erasure does not override phmob's legal obligation to retain financial and KYC records under AMLA requirements.

11. Cross-Border Data Transfers

In the course of operating the phmob platform, certain personal data may be transferred to and processed in countries outside the Philippines — for example, where cloud infrastructure or game software providers are based in other jurisdictions.

Where phmob transfers personal data outside the Philippines, we ensure that appropriate safeguards are in place as required by the NPC, including:

  • Data Processing Agreements with receiving parties that impose data protection obligations equivalent to those under RA 10173
  • Transfer only to jurisdictions that have been assessed as providing adequate data protection, or where contractual protections are in place
  • Notification to the NPC of cross-border transfers involving sensitive personal information where required by NPC Circular 16-01

By using the phmob platform and agreeing to this Privacy Policy, you consent to such international transfers of your personal data subject to these safeguards.

Changes to This Privacy Policy

phmob reserves the right to amend this Privacy Policy at any time. When material changes are made, we will notify registered players via email to their registered address or via a prominent notice on phmob.vip at least 14 days before the changes take effect. Continued use of the phmob platform after the effective date of any update constitutes acceptance of the revised Privacy Policy.
